What the code requires of a driver who leaves

Vehicle Code 20001 makes it an offense for the driver of a vehicle involved in a crash resulting in injury or death to fail to stop and comply with the statute's duties. The penalties in subdivision (b)(2), applying where the crash resulted in death or permanent serious injury, run to imprisonment for two, three or four years, or ninety days to one year in county jail, together with a fine of one thousand to ten thousand dollars. Vehicle Code 20003 sets out what the stopping driver must actually provide, including name, address, vehicle registration information and, on request, driver license identification, along with identification to any traffic or police officer at the scene.

The twenty-four hour reporting requirement

Vehicle Code 20008 requires a written report of a collision resulting in injury or death to be forwarded within twenty-four hours to the Highway Patrol or, where the crash occurred in an incorporated city, to that city's police department. That deadline exists independently of any claim. Separately, Vehicle Code 16025 requires drivers involved in a crash to exchange specified information at the scene, with a fine not exceeding two hundred fifty dollars for a violation. Where no other driver stayed, the reporting duty falls entirely on the person who was hit, and the timestamp on that report frequently becomes the anchor date for everything that follows.

Why the phantom-vehicle version turns on physical contact

Where the vehicle that caused the crash is never identified, the claim usually shifts to your own uninsured motorist coverage, and Insurance Code 11580.2 imposes conditions that do not forgive delay. The statute requires that the unidentified vehicle actually made physical contact with the insured, or with the vehicle the insured occupied. It also requires that the insured or someone on the insured's behalf report the crash within twenty-four hours to the police department of the city where it occurred, or, if it happened in unincorporated territory, to the county sheriff's office or the local headquarters of the Highway Patrol. A sworn statement then goes to the insurer within thirty days.

Geography decides which agency receives that notice

Much of the Victor Valley is unincorporated, so the twenty-four hour notice does not automatically go to a city police department. Note anything the description can be narrowed to: color, body style, whether the vehicle was lifted, wheel type, a lettered door, a distinctive missing panel. Then canvass for footage in the first days. Commercial buildings, fuel stops and gates along desert routes overwrite recordings quickly, and a polite in-person request while the manager still remembers the day works better than a formal demand months later.

The consent trap inside your own policy

Insurance Code 11580.2 also withdraws this coverage where an insured, without the carrier's written consent, either settles with a party who may be legally liable or proceeds against that party to judgment. When a driver is eventually identified and a modest liability check appears, endorsing it can therefore end the coverage that was going to carry the remainder of the loss. The sequence has to be deliberate: identify every policy that might respond, read the endorsement language rather than the summary page, request consent in writing, and only then decide about the liability payment.

Two calendars, neither of which pauses

The deadline for suing a driver who is eventually identified is two years from the injury under Code of Civil Procedure 335.1. The uninsured motorist claim runs on its own accrual rule: under Insurance Code 11580.2 no cause of action accrues unless, within two years of the crash, suit has been filed against the uninsured motorist, agreement has been reached with the insurer on the amount due, or arbitration has been formally opened by certified written notice with return receipt requested.
